When you choose a program, it’s essential to thoroughly review the terms and conditions, as your booking depends on agreeing to these provisions. A formal contract with LUXURY ADVENTURE CUSCO PERU will be established once we receive your filled-out booking form and deposit, followed by our written confirmation. Travel arrangements are only confirmed once you receive written confirmation from LUXURY ADVENTURE CUSCO PERU.
Bookings with LUXURY ADVENTURE CUSCO PERU typically include accommodations, meals, excursions, 10% service charge, specific ground transportation, and other services and taxes as detailed in your proposal. Prices exclude the 18% V.A.T., which applies to Peruvians and foreign residents in Peru only. Foreign travellers can be exempt from lodging and hotel meal taxes by presenting their ORIGINAL passport at the hotel reception.
Your booking does not cover national or international airport departure taxes or visa fees, airport security charges, excess baggage charges, unspecified park entrance fees, additional costs due to flight cancellations or events beyond LUXURY ADVENTURE CUSCO PERU’s control, including force majeure. Also excluded are alcoholic beverages, bottled water, extra drinks, snacks or meals not specified, gratuities, insurance, laundry, phone calls, courier and mail services, flight reconfirmations, and other personal expenses. Special programs, optional excursions, or services not explicitly included in the program are also excluded. Single supplements for solo travellers or those requiring single accommodations/services are not included. Any service not specifically listed as ‘Included’ in the final itinerary is considered excluded.
For each selected program, a deposit per person is required when booking. This deposit includes a non-refundable portion in the event of cancellation by the client.
Confirmation +60 Days Before Your Trip:
Costs incurred to secure bookings, including airline, train, cruise tickets, hotels, and other special services. Note that these may have different cancellation terms and black-out dates with specific policies than those of Luxury Adventure Cusco Peru.
Expenses related to travel design and planning from initial inquiry to the trip, covering communication, assessment, amendments, reservations with experts, guides, third-party suppliers, etc.
Payments must be made as specified in the invoice. Luxury Adventure Cusco Peru covers Peruvian bank taxes and transfer costs, but the client is responsible for taxes and transfer costs from the country of origin.
Note that payment deadlines in our invoices and communications indicate when funds must be received in Luxury Adventure Cusco Peru’s bank account, not when the client sends the funds. Payment delays may incur a 5% surcharge on the total program price to cover re-booking fees and additional work caused by the delay, applicable per re-booking. Delays may also increase costs from third-party suppliers, such as airfares.
LUXURY ADVENTURE CUSCO PERU maintains the right to cancel a program under specific circumstances:
1. Non-Payment by Client: If the client fails to pay the balance by the due date, the program will be cancelled, and cancellation fees will apply (refer to the “Cancellation by You” section below for details).
2. Operational Decisions by LUXURY ADVENTURE CUSCO PERU: LUXURY ADVENTURE CUSCO PERU may also cancel, change, or modify any program, service, or experience without prior notice if:
2.1 It is determined that clients’ safety and/or comfort are at risk.
2.2 an issue with a supplier makes operating the program or providing a service as initially proposed impossible.
LUXURY ADVENTURE CUSCO PERU will strive to reschedule or modify travel arrangements to maintain the trip’s essence. Changes might require an additional payment or partial refund after accounting for cancellation fees and non-refundable deposits.
3. Force Majeure: The program may be rendered impossible to operate due to unusual or unforeseen circumstances outside LUXURY ADVENTURE CUSCO PERÚ control. This includes but is not limited to, technical problems leading to delay or cancellation of flights/travel arrangements, adverse weather conditions, over-booking, closures, strikes, riots, emergencies, government decisions affecting the itinerary, and local situations. Force majeure also covers acts of God, terrorism, uprisings, explosions, floods, storms, fires, earthquakes, wars (declared or not), sabotage, civil disturbances, government interventions, epidemics, and other unforeseen events beyond LUXURY ADVENTURE CUSCO PERU’s reasonable control.
Should LUXURY ADVENTURE CUSCO PERU or any of its suppliers be impacted by Force Majeure, they maintain the right to modify, postpone, or cancel any services or arrangements pertaining to the originally planned program.
Under such circumstances, LUXURY ADVENTURE CUSCO PERU will not be regarded as having violated or breached the terms of this agreement and will not hold any liability towards the client.
If any of the aforementioned circumstances arise during the trip, we retain the right to modify the scheduled itinerary as necessary. Under these conditions, no compensation will be provided.
Should Force Majeure arise before departure, LUXURY ADVENTURE CUSCO PERU will suggest practical alternatives to carry out the program, including proposing new dates or comparable travel options. While we will make every reasonable effort to maintain the original program, alterations and potential price increases might be necessary, and we will endeavour to inform you of significant changes before departure. Any additional costs incurred will be the client’s responsibility. Please note that LUXURY ADVENTURE CUSCO PERU is not obligated to refund any client expenses incurred in preparation for the tour, such as international flights, visas, or vaccinations.
In cases where services, experiences, or the entire program is cancelled due to Force Majeure, LUXURY ADVENTURE CUSCO PERU will strive to refund recoverable expenses. Standard Cancellation Terms & Conditions will apply if expenses cannot be recovered. Reimbursements may be issued as cash or credit notes with a specified validity, depending on the third-party terms & conditions. LUXURY ADVENTURE CUSCO PERU is not responsible for refunding any third-party services issued as a credit note or voucher for future services. Refunds will be net of airline ticket cancellation fees, non-refundable deposits to local suppliers, and other incurred costs, including those by LUXURY ADVENTURE CUSCO PERU. They will represent the full settlement of any claims due to cancellation. LUXURY ADVENTURE CUSCO PERU is not liable to reimburse any personal expenses for travel arrangements made independently by the client.
Should you wish to make alterations to your confirmed travel arrangements after the deposit payment, LUXURY ADVENTURE CUSCO PERU reserves the right to apply an amendment fee of US$100 per person. Additionally, supplementary charges may be imposed by airlines, hotels, or other service providers.
For the inclusion of supplementary services such as train tickets, domestic airfare, etc., LUXURY ADVENTURE CUSCO PERU will levy a minimum 10% amendment fee for each requested service. Any modifications made will prompt a repricing of the reservation based on prevailing rates at the time of the change. It’s important to note that alterations involving changes to the travelling group members might incur cancellation fees as per the policies of suppliers and/or governmental regulations.
In cases where LUXURY ADVENTURE CUSCO PERU incurs significant communication charges or other expenses due to requested amendments, the client will bear these expenses. Amendments requested after the commencement of the tour will be accommodated to the best of our ability; however, we cannot guarantee their feasibility. Should such changes be implemented, the client will be responsible for any cancellation/retention charges applicable to previously booked services and for covering any costs incurred by LUXURY ADVENTURE CUSCO PERU in arranging the revised itinerary.
You must notify LUXURY ADVENTURE CUSCO PERU in writing if you need to cancel your travel arrangements. The cancellation will be considered official upon receipt of your email, as our actions are based on receipt.
Cancellations communicated on Fridays for program departures scheduled for the upcoming weekend (Saturday, Sunday, or Monday) will be treated as cancellations on the day of departure. We encourage you to provide the reason for cancellation, as it may be relevant to your insurance coverage.
Once the trip has commenced, LUXURY ADVENTURE CUSCO PERU does not provide partial refunds for any unused trip arrangements or for trip members who do not complete any portion of the itinerary. Refunds for lost, misplaced, or damaged travel tickets or vouchers will not be issued.
Cancellation charges for airfare, train tickets, cruises, and other services may vary. Therefore, obtaining trip cancellation and interruption insurance is highly recommended to safeguard against unforeseen circumstances. Please note that no refunds will be granted for cancelled or unused services under any circumstances.
In the event of cancellation by the client, LUXURY ADVENTURE CUSCO PERU will apply a cancellation charge to account for nonrefundable advance payments made on your behalf, communication expenses, and a management fee for the time invested in crafting and organizing your trip.
As outlined in the ‘Cancellation Charges’ table below, cancellation charges will be calculated based on the date LUXURY ADVENTURE CUSCO PERU receives your cancellation request in writing and acknowledges its receipt. Please note that LUXURY ADVENTURE CUSCO PERU will not refund any deposits, administration charges, insurance premiums, or other fees or charges made by LUXURY ADVENTURE CUSCO PERU and paid by you about your trip upon cancellation by you.
LUXURY ADVENTURE CUSCO PERU incurs costs from the moment you make your booking, and you agree that any cancellation will require compensation for incurred losses and expenses, as per the table below. The cancellation charges escalate as the cancellation is closer to your departure date.
We strongly advise obtaining insurance coverage for cancellation that adequately reflects the value of your holiday. If your insurance policy covers the reason for your cancellation, you may be eligible to reclaim these charges (please refer to the ‘Travel Insurance’ section of this document).

The costs associated with our travel design and planning from the moment an inquiry is received until the trip commences. This includes all communication, assessments, amendments, reservations with experts, guides, third-party suppliers, and other related tasks.

The program price is determined based on the agreed number of participants at the time of booking confirmation and is therefore applicable only for this specific number of guests. Any decrease in the number of guests due to cancellations may result in an increase in the total program price per person, which would then apply to the remaining participants. Conversely, an increase in the number of guests may reduce the program price per person.
All prices are stated in U.S. dollars and are based on the applicable exchange rates when booking confirmation unless explicitly stated otherwise. While we endeavour to maintain the quoted program prices, we must acknowledge that our trips are often arranged well in advance, making them susceptible to fluctuations. In certain instances, beyond our control, such as significant cost increases due to various factors, including but not limited to entrance fees, transportation expenses (e.g., airfares, train fares, boat tickets), National Park fees, hotel rates, and taxes, we reserve the right to adjust program prices accordingly.
We commit to providing detailed explanations and justifications for any surcharges before their implementation. Additionally, in cases where a specific rate or inclusion was inaccurately communicated, adjustments may be necessary.
Validity periods for proposals and price quotations extend for 15 days from the date of issuance unless otherwise specified. Confirming and booking the proposed program after this period may result in revised rates, which could be influenced by changes in flight costs, exchange rate fluctuations, or supplier rate variations.
The program price is determined based on the number of participants confirmed at the time of booking and is therefore applicable only to this specified number of guests. Any decrease in the number of guests may increase the total program price per person, which would then be applicable to the remaining participants. Conversely, an increase in the number of guests may reduce the program price per person.
Please note that LUXURY ADVENTURE CUSCO PERU can guarantee airfares only for fully paid reservations. Hence, it is recommended to make full payment for airfares upon booking to secure against rate increases, fuel surcharges, and potential cancellation of airline reservations. Additionally, it’s essential to be aware that government and third-party-imposed taxes and fees may change at any time and are not covered by LUXURY ADVENTURE CUSCO PERU.
Certain itineraries offered by LUXURY ADVENTURE CUSCO PERU are crafted to immerse participants in the authentic nature of the visited environment. Consequently, they entail a degree of personal risk and exposure to potential hazards, which could lead to physical or emotional injury, paralysis, death, or damage to the client’s property or to third parties. The client acknowledges that such risks cannot be entirely eradicated without compromising the fundamental essence of the activity and thus assumes them to be inherent to the tour. By participating, the client confirms awareness of their physical and health condition and voluntarily chooses to undertake the risks mentioned above. The client absolves LUXURY ADVENTURE CUSCO PERU from any liability related to accidents or injuries that may arise concerning the client’s health, physical condition, or other factors.
Throughout the duration of the trip, various lodges, ground operators, and third parties may offer guests opportunities to engage in diverse excursions, such as horseback riding, paragliding, or other activities, either for a fee or complimentary. It’s important to note that LUXURY ADVENTURE CUSCO PERU neither owns, operates, manages, nor supervises any of these facilities, staff, or activities. Consequently, all such activities are undertaken solely at the risk of the participating client.
It is imperative that our guests anticipate unforeseen circumstances. We strongly advise all guests to invest in comprehensive travel insurance, ensuring coverage for all activities included in the trip. We recommend insurance that encompasses adequate cancellation protection, including ‘cancel for any reason’ (CFAR) coverage to safeguard against unforeseen events, as well as medical expenses, including coverage for COVID-19, emergency evacuation, and repatriation costs for all activities.
Please be aware that travel insurance offered by certain credit card providers may provide only minimal coverage. Regardless of your insurer, it’s essential to carefully review any exclusions related to the activities you’ll be undertaking.

Numerous sites and services in Peru mandate bookings to be made with your precise and comprehensive personal details, encompassing your full name, nationality, passport number, date of birth, and other pertinent information. Please furnish this information promptly to secure permits/services if they become sold out. If not, accurate information is provided, there’s a risk of acquiring permits/services that may be rejected at the entry point if they do not align with your original documents. In either scenario, LUXURY ADVENTURE CUSCO PERU cannot be held liable.

LUXURY ADVENTURE CUSCO PERU implements suitable technical and organizational measures to prevent unauthorized or unlawful processing of personal data, as well as accidental loss, destruction, or damage to such data commensurate with potential harm. Your personal data will be retained by us for the duration necessary to fulfil the purposes of your trip.
The Guest Information Forms requested by LUXURY ADVENTURE CUSCO PERU are of paramount importance. Your journey may involve travel to remote areas with limited medical facilities, and evacuation may be delayed for extended periods. While many travellers with various medical conditions can undertake their journey without complications, we must have access to a comprehensive and truthful medical profile in the rare event of a severe health issue during the trip. Therefore, you must provide complete and candid information.
LUXURY ADVENTURE CUSCO PERU may require your physician to certify your medical fitness by signing a Medical Verification, attesting that you are sufficiently healthy to embark on your journey. We reserve the right to disqualify any individual at any time, before or during the trip, for medical or psychological reasons. Each guest is ultimately responsible for their own medical expenses. We cannot refund costs associated with medical examinations or other fees incurred during trip preparation.
Suppose a guest arrives at the beginning of a trip with a pre-existing condition or injury that was not disclosed to us in writing and subsequently is required to leave the trip due to this undisclosed condition. In that case, the guest will be responsible for all additional evacuation expenses incurred.
Information provided to us on our Personal Information Forms will be held in strict confidence and will not be shared or disclosed except as described herein.
Throughout the duration of the tour, the decisions made by the company’s guide or representative will be deemed final in all matters that may pose a risk to the safety and welfare of the group. It is imperative that the client strictly adheres to the laws, customs, prescribed protocols, and regulations regarding foreign exchange and drugs in Peru at all times. Failure to comply with these regulations, or any behaviour that jeopardizes the group’s welfare, may result in the guide or company representative instructing the client to leave the tour without any possibility of a refund.
Before participating in the program, each traveller must ensure they possess the appropriate documentation and information. This includes having a valid passport with at least six months validity from the date of entry and obtaining all necessary visas for the entirety of the journey. While LUXURY ADVENTURE CUSCO PERU may provide information or advice on visas, vaccinations, insurance, climate, clothing, baggage, special equipment, and other matters, such guidance is offered in good faith and without liability on the company’s part.
LUXURY ADVENTURE CUSCO PERU and its employees, shareholders, officers, directors, and affiliates do not own all entities providing goods or services for your trip. While LUXURY ADVENTURE CUSCO PERU directly operates some services in the program, arrangements are made with airlines, hotels, and other independent parties to provide the travel services you purchase. These include lodging facilities, transportation companies, food service providers, equipment suppliers, and specialized operators. While LUXURY ADVENTURE CUSCO PERU takes reasonable steps to ensure that service providers maintain quality standards, they are independent suppliers over whom we have limited direct control.
The company shall not be liable for any damage or loss if the failure to carry out the contract is:
LUXURY ADVENTURE CUSCO PERU will make efforts to minimize the effects of such matters but cannot accept liability for them. This includes unforeseen events along the itinerary that may cause delays or modifications to the scheduled program, as last-minute activities in certain locations may occur without notice or may have been planned after the program was designed. The client accepts responsibility for any additional costs incurred due to these factors.
LUXURY ADVENTURE CUSCO PERU will not be liable for damage to or loss of property, injury, death, delayed baggage, inconvenience, loss of enjoyment, distress, mental or physical frustration, or any other consequences resulting from acts or omissions of service providers, including airlines, transportation companies, hotels, or any third party involved in providing services or accommodations. This includes overbooking or downgrading of accommodations, insolvency, financial failure, bites or attacks by animals, insects or pests, lack of appropriate medical care, weather conditions, acts of terrorism, force majeure, quarantine, criminal activity, or any other cause beyond its control.
If a supplier withdraws a service, LUXURY ADVENTURE CUSCO PERU will refund all monies paid by the participant for that service.
During your travel, disruptions and situations may occur, including delays, itinerary timing or routing changes, trip leaders, lodging or camping accommodations, and transport modes or quality. LUXURY ADVENTURE CUSCO PERU may make last-minute decisions to address changed circumstances.
When travelling with an airline, that airline’s carriage conditions apply, subject to international agreements that may limit or exclude liability. LUXURY ADVENTURE CUSCO PERU is not liable for expenses or consequences resulting from flight delays, cancellations, or missed connections, and the client bears such costs.
It is the responsibility of all guests to choose or tailor a trip that aligns with their physical capabilities and interests. It is their responsibility to ensure they are in suitable health to undertake the booked journey and seek medical advice from their physician if necessary. Clients and guests must thoroughly review and sign all pre-departure information, including health-related details, safety protocols, terms & conditions, affidavits, and any other pertinent documents. They are obligated to bring all necessary documents, equipment, and appropriate clothing for the journey while also maintaining personal hygiene standards and adhering to local laws and customs. Smoking is strictly prohibited in buses or cars, below decks on boats, in camps, or other designated non-smoking areas.
Guests acknowledge that their travels may take them to remote regions in less developed countries, where amenities and standards may vary from those in industrialized nations. This encompasses considerations such as urgency, attention to detail, quality standards, hygiene, political stability, cuisine, sanitation facilities, cleanliness, infrastructure, telecommunications, business practices, medical facilities, and evacuation procedures, which may be unavailable, subpar, or not on par with industrialized nations.
Should a client find any aspect of our services unsatisfactory during the trip, immediate notification to LUXURY ADVENTURE CUSCO PERU is crucial for timely resolution. Any subsequent complaints must be formally submitted to the company in writing within seven days following the conclusion of the tour.
Please be advised that complaints must be raised during the trip to enable LUXURY ADVENTURE CUSCO PERU to address them promptly. Please note that complaints will only be entertained after the trip’s conclusion if LUXURY ADVENTURE CUSCO PERU has been duly informed during the journey.
All claims or disputes will be exclusively addressed in Cusco, Peru, under Peruvian Law and the jurisdiction of its courts. Claims for damages against LUXURY ADVENTURE CUSCO PERU are limited to the value of the specific item in question, with any liability capped at the total price paid for the tour. The company explicitly disclaims liability for indirect, incidental, or consequential loss or expense, including loss of profits.
LUXURY ADVENTURE CUSCO PERU acknowledges responsibility for its representations. Still, it does not accept liability for those made by others, including any LUXURY ADVENTURE CUSCO PERU employee or independent travel agent.
By making reservations for any LUXURY ADVENTURE CUSCO PERU program or tour, clients consent to all provisions outlined in the Booking Terms & Conditions, binding themselves and all participants to these terms.
Upon making reservations for any LUXURY ADVENTURE CUSCO PERU program or tour, clients affirm their consent to abide by all provisions outlined in the Booking Terms & Conditions. This agreement binds both themselves and all participants to these terms.
